OUR PRIVACY POLICY EXPLAINED
1.0 Introduction
”Financeacar” is a trading name of Smart Car Finance Ltd. which is an
independent intermediary dealing with selected finance companies and third party
Partner Entities. Smart Car Finance is authorised and regulated by the Office of
Fair Trading. We are registered with the Data Protection Commissioner under the
registration number Z1863597 and we fully comply with its legal obligations and
principles set out in the 1998 Data Protection Act. The Act ensures that all of
your personal information is handled with the utmost confidentiality and only
used for the purpose for which it was collected for. We also strive to keep your
data as accurate as possible and therefore should any of your details or
circumstances change we will immediately amend our databases and records after
being informed by you.
By choosing Financeacar we understand that you have placed a great deal of trust
in Smart Car Finance Ltd. We also know that you will want all personal
information that you submit to us to be kept as private and as secure as
possible. The Company is committed to protecting your privacy.
This Privacy Policy was updated on 31 August 2011. We may change the terms of
this Privacy Policy from time to time and you should check it regularly. Your
use of the Financeacar website will at all times be subject to the Privacy
Policy applicable at the time of each use.
By supplying data to us you will provide information about yourself and others,
defined under the Data Protection Act 1998 as personal data or sensitive
personal data. For the purposes of the Act, the Data Controller will be Smart
Car Finance Ltd. Data will be used by us, our third party Partner Entities and
the finance providers for the purpose of providing you with a car finance
agreement.
The finance providers may carry out checks with credit reference and fraud
prevention agencies in order to provide you with a car leasing agreement. We may
also contact you in relation to other products and services provided by us. We
may disclose information you provide to our trusted partners who may contact you
about the credit facility or to let you know about other products and services
that may be of interest to you.
By supplying data you give explicit consent for all data provided to be used in
the ways that are outlined in this privacy statement unless you tell us
otherwise.
This Declaration is written as if one person were making an application. For
joint applications please read 'I' as 'we', 'my' as 'our' and 'me' as 'us'. It
is important that you read and understand the section below at 4.0 entitled
“Purposes For Which We Use Information About You” (including Credit Reference
and Fraud Prevention Agencies and Keeping You Informed). By proceeding with an
application, you consent to us using your information.
2.0 Security
Security is very important to Smart Car Finance Ltd and we use sophisticated
technology to ensure that your information is protected at all times. Additional
security procedures are in place to protect the confidentiality and integrity of
your information.
We maintain physical, electronic and procedural safeguards in connection with
the collection, storage and disclosure of personally identifiable customer
information. Our security procedures mean that we may occasionally request proof
of identity before we disclose personal information to you.
It is important for you to protect against unauthorised access to your password
and to your computer. Be sure to sign off when using a shared computer.
As a company that provides its products and services over the Internet, we
understand the importance of security. That's why we've created highly secure
facilities to give you confidence when you give us your bank details. In such
circumstances, we use Secure Sockets Layer (SSL) technology to encrypt your
details whilst they travel from your computer to our system. This ensures your
bank details (if provided) are kept private except where we have advised you
otherwise in our terms and conditions.
Keeping information about you secure is very important to us. However, no data
transmission over the internet can be guaranteed to be totally secure. As a
result, whilst we strive to protect your personal information, we cannot ensure
or warrant the security of any information which you send to us, and you do so
at your own risk.
3.0 Information collection
3.1 In the provision of the Service, you will submit your personal information.
All data is kept in a secure environment. We will treat all information
submitted by you in accordance with the terms of this privacy policy (as updated
and amended from time to time) and in strict compliance with all applicable Data
Protection legislation.
3.2 In accordance with the Privacy & Electronic Communications Act 2003 we do
not send random marketing emails to personal email addresses.
3.3 The "Customer Information" we may collect relating to you will be, including
but not limited to your name, address, email, telephone numbers and postcode and
if you place an order though us (as opposed to a third party Partner Entity) we
will require your bank or credit card details, and possibly other information.

3.4 We will not collect or process sensitive information relating to you without
your explicit consent and your Customer Information will be processed by us for
the purpose of : 1. the provision of the Service; and 2. to check your credit
record with any credit reference agencies and for fraud prevention purposes
(which will include the supply of your Customer Information to third parties for
such purposes) should you decide to apply for finance.
3.5 By agreeing to our Service, you agree to the processing, disclosure and
retention of the Customer Information. You also agree that the Purposes for the
processing may be amended to include other uses or disclosures of Personal
Information following notification to you.
3.6 If you wish to update or correct any inaccuracies in your Customer
Information or if you have any other comments or complaints in relation to the
Service please let us know by e-mail to

3.7 Other information that we may keep is:
1. information that is necessary for us to recognise you as a registered
customer and to fulfil the orders you place with us.
2. a record of the cars you lease or finance through our service, which means we
can deal a lot quicker with any problems you may experience with your
contract(s) and/or vehicle(s);
3. We may keep a record of e-mail correspondence you send us. This helps us keep
track of your likes and dislikes and any problems or concerns you've had with
our products or services;
4. Telephone calls made to our Customer Service Helpline may be recorded for
monitoring and quality control purposes;
5. Your preferences and use of email updates, recorded by emails we send you (if
you select to receive email updates on products and offers);
6. Your IP Address, this is a string of numbers unique to your computer that is
recorded by our web server;
7. Data recorded by the Website which allows us to recognise you and your
preferred settings, this saves you from re-entering information on return visits
to the site. Such data is recorded locally on you computer through the use of
cookies (see Cookie heading below). Most browsers can be programmed to reject,
or warn you before downloading cookies, information regarding this may be found
in your browsers help facility;
8. The provision of the Services to you may also require us to store details of
your transactions, together with details of your financial information. We will
periodically review your personal information to ensure that we do not keep it
for longer than is necessary;
4.0 Purposes for which we use information about you
4.1 We may use your personal information for the following purposes: 1. to
enable you to access and use the Services; and/or 2. to personalise aspects of
our overall service to you; and/or 3. to communicate with you; and/or 4. to
process a transaction between you and a third party.
4.2 All the information we collect via our website or through correspondence
with you is used to operate and improve the service we offer you. We are
committed to using your personal information only for the following purposes:
1. Dealing with orders and accounts for the supply of our services and related
products.
2. Monitoring and improving our website and our services.
3. Planning and managing our website, business activities, including analysing
customers' shopping habits and preferences.
4. Enabling third parties to carry out technical, logistical or other functions
on our behalf.
5. Conducting market research including statistical analysis of customer
behaviour which we may disclose to third parties in depersonalised, aggregated
form.
6. Providing you with information about the products and services we offer.
7. Providing you with periodic communications (this may be by post, telephone,
SMS, email or another form of communication) about features, products, services,
events, promotions and special offers. Such communications from us might include
advertising for or offers from third parties. If you wish to withdraw your
consent from receiving these communications you can do so by informing us in
writing.
8. Enabling our debt collection agency to collect payment from you should that
be necessary.
9. Preventing and detecting fraud or abuses of our website.
10. Allowing us to comply with any requirements imposed on Smart Car Finance Ltd
by law or court order.
11. It is necessary for us to obtain some of your personal information if you
are purchasing our products and services. This information will not be sold or
distributed to any third parties without your full consent that you will provide
when you accept our terms and conditions. During our data collection, we may
wish to obtain some more of your personal information however you are not
obliged to supply this information. Once we have obtained your information we
will be able to (with your full consent) provide you with additional information
regarding our company and products. We may also collect demographic and profile
data in aggregated form in order to assess our advertising effectiveness and
understand our customer's preferences.
12. The Automated Logging of Data - Our website enables us to recognize your
Internet Protocol ('IP') address for administrational reasons and so we can
identify you. This may be used to collect demographical data as well as monitor
the frequency of your visits.
13. Using Your Personal Information - The details we are given by you will be
used in conjunction with the service you have applied for and general
administration purposes. We use a number of other companies and individuals to
perform functions on our behalf. For example we engage companies to analyse
customer information, provide marketing assistance, process credit card
payments. We also engage agents including credit reference agencies, fraud
prevention and detection agencies and debt collection agencies that we use to
process the orders you place with us or who assist us in the service we provide
to you. In these instances, we provide them with only the information they need
to perform their function and they will not be allowed to use your personal
information for their own purposes.
14. To process your order and to provide after sales service we may pass your
details to another organisation to supply/deliver products or services you have
purchased and/or to provide after-sales service);
15. Sometimes we send offers to selected groups of customers on behalf of other
business. If you wish to withdraw your consent from receiving these
communications you can do so by informing us in writing.
16. If our company is ever sold or its assets are purchased by another company
it would typically be part of such a transaction for customer information to
form part of the business assets being transferred but the information will
remain subject to the obligations as outlined in this Privacy Policy.
17. We release account and other personal information when we believe release is
appropriate to comply with the law, to enforce our Terms and Conditions and
other agreements or protect the rights, property or safety of Smart Car Finance
Ltd, our trading brands, our customers or others. If you provide us with
Customer Information, it is important that you give us accurate details. We
shall check your details with fraud prevention agencies and if you give us false
or inaccurate information and we suspect fraud, we shall record this. We shall
add to your records with credit reference and fraud prevention agencies
information relating to your application or your account and any default or
failure by you to keep to its terms. These records and records obtained from
credit reference agencies, as described above, shall be shared with other
organisations that make searches and shall be used by us and them.
5.0 Your rights
You have the right to request a copy of any information that we currently hold

6.0 Cookies
Cookies are small text files that web sites can send to your computer. A cookie
can be thought of as an internet user's identification card, which tells a web
site when the user has returned. Cookies are not computer programs, and can't
read other information saved on your hard drive. They cannot be used to
disseminate viruses, or get a user's e-mail address etc. They only contain and
transfer to the web site as much information as the users themselves have
disclosed to that web site.
Cookies make the interaction between users and web sites faster and easier.
Without cookies, it would be very difficult for a web site to remember the
user's registration details for a future visit. Our website uses cookies to
record a customer’s preferences allow customers to move from one part of the web
site to another without having to login repeatedly. It also allows us to give
you accurate information about your account and order history.
The European Union Directive on Privacy and Electronic Communications (the
"Directive"), which came into force on 31st July 2002, recognises that cookies
are a "legitimate and useful tool" for many activities, including verifying the
identity of web site users. The Directive makes it compulsory for web sites to
inform users if cookies are being used, and to provide some information on how
cookies are used. You can find more information on this subject at
aboutcookies.org. Finally, the Directive places an obligation on web sites to
make users aware that they can set their computers to reject cookies. You will
find the instructions on how to do this at aboutcookies.org. However, you should
be aware that the "Car leasing made simple." website may not work correctly
without cookies.
7.0 Unsuccessful
Should your application be unsuccessful, we may pass your details to an
alternative finance provider who will conduct a credit search with a credit
reference agency to see whether they can find you an alternative finance
arrangement. If you do not want us to take this step please notify us at point
of application, your application will be processed by us in the usual way and we
will inform you of the result. If unsuccessful, your details will not be passed
to an alternative loan provider.
8.0 Feedback
In order to ensure the Services we provide you continue to meet your needs we
may ask you for feedback on your experience of using the site. Where we do, such
data will only be used as part of our programme of continuous improvement and
will not be published on the site.
9.0 Third party providers and data privacy
If you decide to enter into a contract with a third party provider through a
channel on our website, the information you have provided to us together with
any further information requested by, and supplied by you to, the third party
provider will be held by the provider for the purposes set out in that
provider's privacy policy. Therefore, you are strongly advised to read your
chosen provider's privacy policy and satisfy yourself as to the purposes for
which the provider will use your personal information before entering into the
contract. We have no responsibility for the uses to which a provider puts your
personal information once you have contracted with that provider.
